The Examinations referred to in M^r Wilsons said Letter
these papers are laid before you for your Consideration and Opinion

Whether as the Court is in posseſsion of the Goods an
Appearance must be given for his Grace the Duke of
Athol in the Court of Admiralty and then for getting
to declare that he does not proceed any further against
such of the said Casks as were found on shore & and you
will be pleased to advise how many and which of the said
Casks appear to you to fall within that Description
and upon the whole what Steps appear to you most
proper and adviseable to be taken in the premisses

We think that as the two Casks found and taken up by James Hanby
with one Cask found by John Cannon were found under Circumstances
that render the right of Property therein questionable and as they are
not of great importance that it would be proper for the Ad-
miralty proctor to declare that he proceeds no further against
them; and we think that this Declaration on the part of the Admi-
ralty proctor may make it unnecessary for the Duke to give
a formal Appearance and Claim
