ANNO REGNI VICESIMO QUARTO Seſſ. 2.
lawful for the ſaid Commiſſioners of Exciſe, by the Te=
nor of the Licences to be by them granted, to reſtrict the
Perſon or Perſons, Receivers of the ſame, to reſide in
ſuch particular Places of the ſaid Counties, Places, or
Diſtricts, as to the ſaid Commiſſioners ſhall ſeem pro=
per for anſwering the Purpoſes hereby intended, the ſaid
Places being always at the Diſtance of Ten Miles,
(according to the Computation of the Country), at the
leaſt, from any entered or exciſeable Diſtillery; and the
Perſons ſo licenſed by them ſhall be obliged, Ten Days
before the Expiration of the current Commiſſion, to re=
new the ſame, and to pay the Monies reſpectively due
therefor; providing, that in caſe the Perſons ſo autho=
rized ſhall neglect to take out new Commiſſions as is
hereby directed, and continue notwithſtanding to diſtill
Spirits, ſuch Perſons ſhall forfeit and loſe the Sum of
One hundred Pounds, and ſhall not be capable of being
again licenſed, and the Commiſſioners ſhall authorize
other Perſons in their Places; providing alſo, that in
the Caſes where new Commiſſions ſhall be iſſued to other
Perſons, upon Account of the Neglect of the Diſtiller
formerly licenſed, ſuch Perſon, if alive, or, if deceaſed,
his Heirs, Executors, or other Repreſentatives, ſhall be
obliged to deliver up the Still and other Implements
belonging thereto, to the Exciſe Officer of the Diſtrict,
upon Payment of the Value thereof, to be determined
by any Two of the neareſt Juſtices of the Peace reſident
at the Time, One to be named by the Officer, and the
other by the ſaid Perſon or his Repreſentatives; and,
upon the Delay or Refuſal of ſuch Delivery or Nomina=
tion of a Juſtice, it ſhall be lawful for the Officer to ſeize
upon the ſaid Still and Implements, and to have the
ſame valued by any Two Juſtices of Peace in the
Bounds, and to conſign the Value thereof in the Hands
of the Sheriff Clerk, or the Clerk of the Peace of the
County, to be by them made forthcoming to the Per=
ſons having Right, at their own Riſk; and the ſaid Still
and Implements are to be at the Diſpoſal of the Com=
miſſioners of Exciſe.
